1. Introduction & Acceptance of Terms

Welcome to opentocolor.com (the “Website”). These Terms & Conditions (the “Terms”) constitute a legally binding agreement between you (whether an individual or the entity on whose behalf you access the Website) and the owners of opentocolor.com (“we,” “us,” or “our”). By accessing, browsing, downloading, or otherwise using any part of the Website you confirm that you have read, understood, and agree to be bound by these Terms, alongside our separate Privacy Policy.

Plain‑language snapshot: You must be at least 18 years old, use our coloring pages for personal or classroom enjoyment only, and play nice—no bots, no scraping, and no offensive re‑use.

If you do not agree with (or cannot comply with) the Terms, please exit the Website immediately. Continued use after a change to the Terms will constitute acceptance of the revised text (§ 14 below).

2. Definitions

TermMeaning
“Content”All printable sheets, images, text, graphics, logos, icons, audio clips, digital downloads, data, and software made available on the Website.
“Non‑Commercial Use”Any use that is not primarily intended for, or directed toward, commercial advantage or monetary compensation.
“Classroom Use”Distribution of printed (hard‑copy) sheets by a teacher, parent, tutor, librarian, or caregiver directly to children in their care.
“Derivative Work”Any adaptation, remix, translation, or other recasting of the original Content that results in a new creative product.
“We/Us/Our”The legal and beneficial owners of opentocolor.com, currently operated as a hobby project without a registered corporate entity.

3. Eligibility & Geographic Reach

  1. Age Requirement. The Website is offered only to individuals who are 18 years of age or older. By using the Website you represent and warrant that you meet this threshold.
  2. Global Access. We welcome visitors worldwide. However, you are responsible for ensuring that your use of the Website complies with all local laws in your jurisdiction. We do not knowingly distribute software or technical data subject to U.S. export control regulations, and we make no warranty that the Website is appropriate or available in all locations.

4. Intellectual Property & Limited License

4.1 Ownership of Content

Unless otherwise indicated, all Content is either owned by us or licensed from third‑party illustrators and designers. All such rights are protected by international copyright, trademark, and related intellectual‑property laws.

4.2 What You May Do

We grant you a personal, non‑exclusive, revocable, and non‑transferable license to:

  • Download digital files for your own personal or classroom use;
  • Print unlimited hard copies for children in your household, classroom, library program, or daycare group; and
  • Share photographs of finished colored pages on social media with proper attribution (e.g., “Artwork © opentocolor.com”).

4.3 What You May NOT Do (Without Written Permission)

  • Redistribute the raw digital files—whether by email, file‑sharing services, or posting the PDF/JPG/PNG/WEBP on any website.
  • Sell or otherwise exploit the Content for commercial gain (e.g., bundle in an e‑book, post behind a paywall, or include in a paid course).
  • Create derivative works such as altered line art, translations, or mash‑ups.
  • Remove watermarks, copyright notices, or attribution contained in the files.

Classroom scenario example: A teacher may print 30 copies of a coloring sheet for her students and send the PDF to a substitute teacher within the same school. She may not upload the PDF to an open Google Drive folder for public download.

5. Acceptable Use Rules

You agree not to:

  1. Use the Website or Content for any unlawful, harassing, hateful, discriminatory, obscene, or defamatory purpose.
  2. Employ automated scripts, robots, crawlers, or scraping tools to extract data or images.
  3. Attempt to gain unauthorised access to our servers or interfere with site performance.
  4. Misrepresent your identity or affiliation when contacting us.
  5. Frame or mirror any part of the Website without express permission.

We reserve the right to investigate and prosecute violations to the fullest extent of applicable law.

6. User Accounts & Comments

We currently do not provide user registration, comment sections, forums, or the ability to upload user‑generated content. Should these features be added in the future, separate guidelines and moderation policies will apply, and these Terms will be updated accordingly.

7. Purchases, Memberships & Refunds

The Website presently offers free resources only. No e‑commerce storefront, payment gateway, or premium membership program is in operation. If we introduce paid offerings in the future, the following baseline rules will apply:

  • Payment Processors. Transactions will be handled by a trusted third‑party processor (e.g., Stripe or PayPal). No payment card details will be stored on our servers.
  • No‑Refund Digital Goods. Because digital files cannot be “returned,” all sales will be final unless the file is defective or fails to download.
  • Full Terms of Sale will be published prior to launch.

8. Affiliate Links & Sponsored Content

We do not currently run affiliate programs, sponsored posts, or paid product placements. If we choose to do so later, we will comply with the FTC’s endorsement guidelines, clearly marking any compensated content with #ad or #sponsored disclosures.

9. Availability, Updates & Downtime

We strive to keep the Website available 24/7, but we make no guarantee of uninterrupted service. Planned maintenance or unexpected technical issues may render the site temporarily unavailable. We are not liable for any losses resulting from such downtime.

10. Disclaimer of Warranties

THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” While we aim for accuracy and high artistic quality, we make no representations or warranties—express or implied—regarding:

  • The completeness, correctness, or timeliness of any information;
  • The compatibility of files with your printer, paper, or coloring media; and
  • The absence of viruses or other harmful code.

To the fullest extent permitted by law, we expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

11. Limitation of Liability

Direct Damages Cap. In no event shall our total liability, whether in contract, tort, or otherwise, exceed USD $50 (or the total amount you actually paid us, if any).

Indirect Damages Exclusion. We shall not be liable for any indirect, incidental, consequential, or punitive damages—such as loss of profits, business interruption, or data loss—even if advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations; in such cases our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless opentocolor.com, its owners, licensors, and service providers from and against any third‑party claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the Content.

13. Termination of Access

We may, in our sole discretion and without prior notice, suspend or terminate your access if we believe you have violated these Terms or engaged in behaviour we deem inappropriate. Upon termination you must permanently delete all digital files obtained from the Website and destroy any remaining hard copies in your possession, except those already coloured and kept for personal sentimental value.

14. Modifications to the Terms

We reserve the right to amend these Terms at any time. A new “Last updated” date will appear at the top of this page, and newsletter subscribers may receive an email summary of material changes. Your continued use of the Website after any modification constitutes acceptance of the updated Terms.
